News-Miner editor testifies in Joe Miller lawsuit

FAIRBANKS — News-Miner Managing Editor Rod Boyce testified Thursday that an interview with a former borough mayor and an anonymous letter heightened the newspaper’s interest in the work history of former U.S. Senate candidate Joe Miller.

Boyce was questioned during a two-hour deposition as part of a lawsuit Miller has filed against the Fairbanks North Star Borough and former Mayor Jim Whitaker. In the lawsuit, Miller accuses the borough and Whitaker of improperly releasing his private information before the 2010 general election.

A handful of borough employees and political blogger Andrew Halcro have also been deposed in the suit in the past several weeks. Miller’s lawsuit is an outgrowth of a media claim that sought release of his personnel records during his time as a part-time borough attorney.

Boyce refused to answer most questions about sources asked by Miller attorney John Tiemessen, citing a state law that gives news organizations protection from revealing informants.

He declined to discuss whether any potential sources were former or present borough employees, elected officials, their relatives or their friends. He also declined to confirm that such sources even existed.

Boyce did, however, discuss two sources that had previously been made public.

He said a document anonymously delivered to the News-Miner was the catalyst for a Sept. 28 public records request for Joe Miller’s employment records at the borough. That document included questions about whether Miller had used borough equipment “for partisan political purposes or activities.”

Boyce said the typed, one-page document was dropped off at the News-Miner front desk and that he didn’t know the author’s identity. Columnist Dermot Cole subsequently submitted the document to the borough as a public records request.

Boyce also discussed a pair of on-record interviews with Whitaker in the month before the election, which were the basis for articles about discipline Miller faced from the borough in 2008 for misusing borough computers. Whitaker said at the time that Miller had violated the borough ethics policy by secretly using other employees’ computers to vote in a poll in an attempt to unseat Alaska Republican Party Chairman Randy Ruedrich.

About two weeks after Whitaker’s initial interview, a judge granted a wider release of Miller’s personnel record following a lawsuit by several media organizations, including the News-Miner. That release confirmed the 2008 computer incident.

Boyce is the second person to decline to discuss sources during the depositions, using the privilege given to news organizations to withhold such information. Halcro, who wrote about Miller’s borough work history on his blog in 2010, offered the same refusal last week. Halcro did say, however, that no present or former borough employee was his source.

Borough attorney Rene Broker is scheduled for deposition Feb. 14 in the lawsuit.

Hang tough Mr. Boyce, you have many, many people who are with you in this fight. You have the right to protect your sources. If not, we all go without.

Pay attention if you love freedom and the right to speak for those who cannot speak.

It's America. If you are going to run for office, then everything you have ever done or said will be scrutinized. As Andrew Halcro put is so well in his blog following his deposition,

"The first piece of political advice I ever received was as true eighteen years ago as it is today; once you decide to knock on the door, you better have thick skin.

Politics is unfair, it's unwieldy, it's unpredictable. More importantly it can get personal really fast. Unless you're completely removed from reality, you acknowledge and accept these risks when you throw your hat in the ring.

(This is a) desperate attempt by someone trying to create an enemies list to explain their Red Soxian collapse down the stretch. All being done at the expense of taxpayers from the Fairbanks North Star Borough.

I can only imagine how many tea bags this is costing them.

Get over it. Get some thick skin. Or get the hell out of politics."

As was noted below, Miller is a bully. And like all bullies, under the tough guy exterior is a pathetic little crybaby.

He's a crybaby who cornered the crybaby vote (you crybabies know who you are, you voted for him). And nearly a year and half later all the crybabies are still at it.

I just read on ADN that Miller is pondering a run for Begich's seat. I'm no fan of Begich but I'd keep him over Miller.

The timing surprises me because Miller is keeping his borough misdeeds alive and in the press with this suit.

I suspect that there are a lot more ghosts in Miller's closet than he wants us to know about. I definitely want Begich out, but Miller could be worse...an embarrassment to Alaska. Let's hope there are some better options out there.

I think the most telling thing about this issue is the lengths that the Newsminer went to publicize Joe Millers "dirty laundry".

I am sure that Borough employees "misuse computers" on a daily basis. So why is Joe different? The logical conclusion is that he was a conservative, non-establishment candidate.

I would love to see ONE story on the efforts that the Murkowski campaign made to bribe native voters. But somehow that doesn't fit into Rod's agenda.

The valentines gift that we get from Ms. Broker's deposition will be VERY interesting. My guess is she refuses to answer a lot of questions. Wonder if the Newsminer will report on that? They seem to be cherry picking what to report so far...

Maybe the focus on Joe was his running for office and claiming he was such an honorable person while the fact showed he was not. Then once the issue came to light Joe sure tried to hide from it. Had he simply been up front and not dodge the issue he probably would have gotten a pass on the matter.

And the real truth for now is who said what to whom is still a mystery. The answer might come as a surprise to all.

There is a difference. Recall Miller's election tactics, his goon squad, the black Hummer followed by his machine gun toting supporters in Chugach. Looked a lot like Germany in the forties. Almost a cult like following gravitated to the person. He thinks he is above the law and still does, and the sad thing is that many of his supporters are blind to it. Either that, or they buy into the same philosophy. Don't think it can;t happen here. It can and it does. The bullets missed Miller on his criminal conduct, and he is lucky. His smartest move would be to call it over before more comes out. And again, how is he paying for his legal stuff? Seems questionable to me, at least. I don't love Whitaker, but at least he had the chutzpah to do the right thing this time. Don't like the borough either, but Miller was part of them and was happy to eat at the trough until caught.

It will be interesting to see if Hellcrow's privilege claim is any good, but Boyce is dead on and it is refreshing to see the DNM stand up to Miller and his lawyer's bullying. It is clear that Miller is a bully who likes to inimidate people. A politician right out of the old school. Not much to say about his lawyer, either.Hope they both go down hard. But how is he paying for all of it? That is the big question which the IRS and election folks should ask.
