Swanny, that was an excellent discussion of why, at many levels, there is little to no enforcement of the ATV laws on the books in Alaska. And that is why law enforcement can't win. For every one person (the letter writer) that complains that a law isn't enforced strictly enough, there is one (or more) persons(s) arguing that it is enforced just fine or too strictly. No matter what the cops do, they can't win, and someone is upset and complains.

Pavel, the areas the letter writer seems to be talking about (and the areas I see the most ATVs in) are far outside NP city limits, so I don't think it's a factor of NPPD wanting to raise more revenue by writing speeding tickets (and the PD and Troopers don't get the money from the tickets anyway.) I give a lot more credence to Swanny's reasons why the laws aren't enforced very strictly.

tsanders, 13 (not 17, which I assume was a typo)AAC 02.125 says:
The driver of a vehicle intending to turn left at an intersection or into an alley, private road or driveway shall yield the right-of-way to a vehicle approaching from the opposite direction which is within the intersection or is so close as to constitute an immediate hazard.
This in no way indicates to me that I must wait at the stop line until I am clear to proceed. It says to me that I may not pull so far into the intersection that I constitute an immediate hazard to oncoming traffic. And 13AAC 02.130 talks about stop signs, which had no relevance in this discussion. Hope this helps.

Those lines are there to tell you where to stop when you have a red light. They have nothing to do with making a left hand turn on a green light. And I have read (and re-read) the Alaska driver's manual. Can you please point out to me the page that says you cannot enter an intersection on a green light while waiting for oncoming traffic to pass before making your left turn?

This entire letter assumes the girl was somehow at fault, even though there seems to be no evidence to support that (i.e. the girl "may" have been going at a high rate of speed.) What evidence does the family have that the girl was at fault or contributed to the stepson's death through some type of negligence. If the girl did nothing wrong (i.e. the stepson crossed the road on a red light while the girl had the green), why does the girl owe the family an apology? Again, these are all IF questions, but they seem to have no more or less basis in fact than what the step mother is saying/asking.

tsanders, I concede your first point (because I haven't specifically looked, and have no reason to believe you are not correct), but disagree with your second point. I do not believe that there is any law saying you may not pull into the intersection when preparing to turn left on a green light. If you can show me otherwise, I will happily admit I am wrong (and change my driving habits accordingly.)

akguy, how can you say both are partially at fault, (meaning Wiken is at least partially responsible for someone's death) and in the very next sentence say that the charge is ridiculous. If Wiken is partially responsible for causing another's death through his negligence, then why should he not be charged?

It is possible for this guy to be at fault if the other driver was waiting, got a green arrow, and the driver being charged ran the light shortly after it turned red. In that case, the driver turning left DOES have the right of way.
