Decade of injustice

April 21, 2008

To the editor:

My name is Eugene Vent, and I, George Frese, Kevin Pease and Marvin Roberts were wrongfully convicted in the John Hartman murder case. It’s been almost 11 years since this tragic event, and we are still fighting for our freedom and will not stop until justice is served.

From day one, we proclaimed our innocence and all evidence besides a couple false confessions and testimony from “jailhouse snitches” points to our innocence. I’ve seen individuals — whether they’re witnesses or people just involved around this case — change their stories numerous times.

I definitely know the four of us and our families would appreciate it if certain people would speak the whole truth regarding the events of Oct. 11, 1997.

I thank everyone who marches and rallies for us. It means the world to us when we see family and friends rallying for us. I hope the courts will give us another chance to prove our innocence. We all now know much more about the legal process, not to mention the new evidence that arose in the years after our trials. I believe that our time is coming and we will be exonerated of all these false convictions and our names will be cleared.

I have to stress that the four of us are completely innocent of this horrible crime. I am confident that justice will prevail and the true culprits will see their day in court and definitely their years in a prison cell. We just hope that comes more sooner than later, because this time has changed us from boys to men.

I have dreams of living life in freedom so I can one day start a family and contribute to society. I have spent my time trying to stay positive and set positive goals for myself, at which most I am successful. Without the support of family and friends I don’t think I would have been able to make it this long. I thank everyone for their undying loyalty and support.

I remember this vividly. My son was six months old. I watched this story on the late news over ten years ago. I was disgusted. I remember sobbing, turning off the tv and creeping into my boys room to watch him sleep, trying to cry silently enough as not to wake him. I watched his tiny chest rise and fall and thanked God he was with me and he was safe. This crime taught me about my role in his life. This crime showed me through mother's eyes what I was up against. What hate is out there. I cannot imagine what John's mother went through in this. I don't want to imagine it.

The interrogations are public. I found yours, Eugene at http://www.uaf.edu/journal/extreme/Hartm.... In it, you said you kicked him about ten times in the body, arms, and head. YOU said that. You said "I am sorry for this." YOU said it. YOU also said, when asked, that you did not feel threatened or coerced by the police during the interview.

YOU get to have dreams of freedom. John Hartman does not. You are where you are so other people can follow their dreams without fearing you.

sonny1player ~ I'm not sure where you get off bringing up racism in a forum that is totally in regards to a gentlemen who claims to have been wrongly convicted. If the evidence didn't prove this gentlemen upon a reasonable doubt he would be free. His "minority" has NOTHING to do with it. Racism lives on... it lives on in people like yourself who believe that just because you are the minority, you should be innocent. Give me a break! COMMIT THE CRIME, DO THE TIME!

I remember this when it happened and I agree with candikane 110%! Unfortunately, I am sure that you will be release into the public again one day---I just pray that no one else is hurt by your hand.

Sony1player--the justice system doesn't care what color you are when you are convicted by a jury of your peers. Nice try--but this guy knows what he did and maybe one day he can just man up!

I was one of the Booking Officers the night of 11 Oct 1997 when ALL four of you were in processed. You probably don't remember me and thats fine with me, but I remember it like it was yesterday. I'm not here to judge you thats been done already; what I will say is you've been through the justice system and had your chance to either come clean or direct law enforcement to the persons you alleged of doing the crime. The bottom line here is 12 individuals had to sit and listen to testimony and you all said nothing. You were found guilty based on the evidence, nothing more nothing less. Now ten years later you are still making the same old allegation of no wrong doing. You have made several choices leading up to this point in your lives and now you have to live with those choices. A mother Miss Hartman will never see her son again, my heart really goes out to her. If you feel the way you do then come clean and give the names up. You've waisted 10 years of your life to protect someone else? Come on. The bottom line here is accept Responsibility. Booking Dude..........

By taking time and reading his statements, it sounds like he was drunk and coerced into saying what the officer wanted him to say. Half the time it is unclear what is being said. I hope this statement didn't have a big hand in the ruling.

Eugene ~ After reading this "letter to the editor" from you, it sickens me to my core. It sickens me because it seems like the only thing you feel remorse for is the mere fact you convicted yourself. You convicted yourself by admitting you had beat that boy because he was (as you claim) "homosexual". After 10+ years sitting in the justice system, the only ounce of remorse you can conjure up is for yourself?!?!
Lets me honest with ourselves here... no one feels sorry for you. Stop writing letters to the free public to gather remorse. You are a convicted felon. You belong where you are. No one out here is going to be writing you letters wishing you well... and saying "I wish the justice system would have treated you better." You're lucky you have an opportunity of freedom, it's more than you deserve!

MrsB--WOW! After taking the time to read the interrogation-I didn't gather that at all! He sounded like a kid that had his hand in the cookie jar and was caught. He was doing everything he could to think of something to say that would get him and his buddies out of the mess they were in. Ultimately it is very clear in the transcript that he admitted to being there and beating this boy.

So sad that we have "judges" among us. How many people are freed from jails after dna evidence was used. The truth will set you free like McGrumpy says. It being a free country, I listen to people when they say things like this. I also kept up on the news, and how it took place as a private citizen. Believing we're innocent "because" of being a minority-- sounds like a racist statement (twingirl). How about the other issues relating to this case, such as "bad cops". Let's question that arguement. How would you like a police officer that just doesn't like you? Maybe he read a cowboy paperback that says "a good indian, is a dead indian". Oh sorry, I forgot we in the u.s.of a. always keep our promises. Like General Custer said "oops"

God is the one who is to judge us, not you all who think because your behind a computer your right. The truth will soon be told. I love you my cousin Eugene, I will forever know in m heart you are in there for no reason.

I just read all THREE interogations that where on the referenced site. In the the third and final session, Eugene did not sound (by choice of word) drunk, he repeated for the third time that he was there and he did say that he took part in kicking him. A lawyer can argue a lot of things about wether the detective should have stopped but the fact is that Eugene did not stop speaking, he continued to answer questions until he spilled his guts. The third part he is read his rights and admits it again. Jury is in, your guilty by your own admission.

I'm open to having my mind changed on this. I'm open to these men proving their innocence. That does mean that proof needs to be offered, though. Someone lied then, or someone is lying now. It's difficult to know which statement from which person is the true one.

I've read the transcripts, and the one thing I wonder about most is the footprint in blood; it's very difficult to explain away. The idea of a false confession gives me pause for many reasons as I would not admit to doing something I didn't do, but that's me - false confessions do happen. There were three trials (correct me if I am wrong, please), all four men found guilty, which is also difficult to explain away. Physical evidence speaks much louder than mere words.

Does anyone have any idea where the court transcripts can be obtained? I admit to ignorance on this; I could be missing the "transcripts" link on the court website. Someone offered me information at one point and that email has since been lost, much to my frustration.

If these men are guilty, then they are exactly where they need to be. If they are innocent, then the justice system failed them, John Hartman and the community, at every step of the way. Which is it?

KYUGRL: Wrong. The courts judged them and found them guilty. Three trials if I remember correctly (anybody feel free to correct me if I'm wrong). That's 36 jurors. Not people sitting behind a computer. I don't care if he's your cousin or the pope. Murder is murder. He had his chance at presumed innocence, the cops, the judge, and 12 independent jurors found him guilty. We are NOT RUDE, we are offended by his brazenness.

just stop arguing! darnit. let people believe what they believe. and candicane, just stop dashing the hopes of an innocent relative. there are innocent people all over the world, and guilty ones, don't let your anger make you hurt more people for no reason. you were cruel in what you said to his cousin. you are entitled to your beliefs, just remember not to go and hurt more than need be. we cannot tell you that these boys are innocent, and you cannot tell his relatives that he is guilty. you are divided, but there is no point in hating each other! this woman has not been convicted of anything! she is believing out of love, and trust, and her heart. just like you might believe in the same way that these boys are guilty. it is her heart that speaks, and defends her loved one. not cruelty! not racism! LOVE! everyone just stop accusing people of racism! look at you! you're letting hate for what happened to this poor boy make you hate people on principle! just stop! what happened to that boy has caused so much harm to his family, to many families, to the community, and no matter how badly you wish it away, it has created an argument for racism from all angles! that is not honoring the life of John Hartman. just stop throwing stones. and know in your heart, that you believe what you believe out of love, not of hate. and if you believe what you believe out of hate, just think about it. and honestly, i will never ever know if these boys are guilty or not guilty. i don't possess the knowledge that only god can possess. that only the lost possess. i do know that hating anymore is just getting tired. it's painful. it hurts.

Now, back to my real comment.

I won't argue whether or not Eugene Vent or the other individuals are guilty/not guilty.

After reading the interrogation one thing was clear- most of Aaron Ring's words were suggestive.

AARON RING: WELL HERE'S, HERE'S THE PROBLEM. HERE'S WHAT YOU DID, YOU BEEN IDENTIFIED WITH THIS GUN OVER AT THE MOTEL. OKAY, I DON'T KNOW WHAT KIND OF GUN, I DON'T KNOW IF IT WAS LOADED. YOU INTENDED TO KILL SOMEBODY OR WHAT. OKAY? THAT'S

EUGENE VENT: HOLY COW, THAT'S GOIN A LITTLE DEEP THERE

AARON RING: YEAH, THAT'S, THAT'S YOU, YOU GOT IN A FIGHT OVER AT THE EAGLES HALL, YOU AND YOUR FRIENDS, OKAY, AND YOU GOT IN A FIGHT WITH ANOTHER ONE OF YOUR FRIENDS OVER AT NINTH AND BARNETTE. OKAY. YOU SEE WHAT I'M SAYING.

EUGENE VENT: AT NINTH AND BARNETTE, THAT'S LIKE (INAUDIBLE) IS THAT LIKE THE ALASKA MOTOR INN

    ***************

Read the 116 pages and then take a look at the following link. It's very interesting..

I am not believing anything out of trust or my heart, I have used my head to follow a trial that has completely shaped the way I have raised my children. He took MY innocence. Other people than those that are obvious were hurt by this. AND you are out of line lumping me in a paragraph about racism. There is nothing racist in what I've said or what I believe. In fact, here's a quote of mine from April 15th in the Racism lives on thread:

lagirl: The native cultures and the American/Fairbanks cultures are different. Your lack of "warm and fuzzy" feelings is your problem, not theirs. Dismissing another person's culture, albeit I think probably unintentionally, is narrow-minded. Would you go to Japan and expect them to look you in the eye and shake your hand? There was nothing racist in katiemom's comment, but she could make a decent arguement for yours. http://newsminer.com/news/2008/apr/15/ra...

banks907: All of that speculation was addressed in his denied appeal. http://touchngo.com/ap/html/ap-1864.htm

What strikes me in this letter is not what was said, we have been hearing it for 10 years now, but what was not said. How about "I'm sorry for what happened, to your son, brother ,friend. I did not do it but let me help identify who did." This letter is nothing but an empty plea to help himself. Remember no matter how bad you have it, it is not worse than what happened to a CHILD that night long ago. The lack of value for human life is what got you into this in the first place and until that is learned I hope you stay right where you are.

If you are innocent, please prove as much. If you are guilty, apologize and look forward to the day of your release. In either case, public opinion will not be swayed by your letter so let it lie.

I remember when I read about this and wished I was there on the corner with my CWP. So very sad another life was ended for no reason.

I hope the friends and family of this boy find comfort and solace in the fact that he is in a better place....They are the real victims - not the writer

on the original web posting that contains 116 pages, there are THREE different interviews from THREE different times! During the first, Euguene is obviously hammered, that is the interrogation that banks907 has clipped and posted above. I read all 116 pages yesterday and I can tell you that the meaning I took from 'thats goinga little deep there' was not Eugene saying stop or being coherced; it was a drunk teenager trying to avoid questions that he already knew the answer to. During that same sit down session when the other officer came in and informed them that they had arrested Kevin Pease and Harley, Eugene says that things just got real deep again. It is a term of expression that he was using back then.
His confession had to be brought out, that kid knew what happened and lied and then changed his story after letting a little slip. Then he would lie and cover that slip up to let something else come out; by the time he got done talking he had changed the story at least eight times that I counted. That was all in the first interrogation! The second and third, Eugene was a little more sober and did apologize for what they had done, he DID admit that he and the others had kicked John in the head. He DID NOT say that they sexually assaulted him but he did admit to the assault.
Eugene was offered for the third time an attorney and for his mother to be present during questioning and he turned it down after saying that he had already talked with his mother about what had happened. THEN he went into the same story about getting a short bag of weed and the three of them going back and kicking the crap out off him while they where drunk. He admitted to it after being mirandized, offered attornies, offered parents and for the THIRD TIME he confessed! This was not coherced!
This kid killed someone and because his attorney has him convinced that the confession should be thrown out he is still babbling to the public about his innocence! Never mind what I said (three times)my attorney is right, I dont know what I was saying because he wasnt there! Oh pooh!

I am a Native guy who grew up in this town and know two of the guys convicted for this murder.
All I can say is that there are many, many decent, honest, hard-working Native families doing their part as productive members of society. I am one of many.
All I can say is that TRY not to judge a race just because of a few who are plastered on papers such as this one. As for the AFN being racist, I don't agree with that because I was there, and I do not go around being racist when I see an opportunity, nor would I allow such behavior practiced around my young ones. I believe that it is so easy to go and judge a whole by such a few, and hard to learn about individuals- I have my shortcomings but I do realize this. I hope you can too.

Yep racism lives on.. The non native wouldn't see it even if it kicked them in the butt. These 4 men always claimed they were innocent! There was and is no DNA evidence linking them to Hartman. No tissue, blood or hair on anyones shoes or clothes. The way Hartman was kicked up there would have been all kinds of blood, hair and tissue flying through the air and stuck on their shoes and clothes. Any hunter who's butchered a moose in winter will tell you that.
Aaron Ring is said to be prejudiced by a person who went to school with him. Prosecution witnesses Chris Stone and Arlo Olson admitted lying and their stories changed everytime Aaron ring and O'Bryant went to see them in the can.
Chris Stone was doing drugs with Hartman that day and also Hartman was found with Stones large pants on him.
The prosecution photos of Hartmans head were doctored sop that the suspects shoes could fit into them.
Racism.. The prosecutor said. "Don't trust the village people. They'll back each other up. No matter what"!
The tens of witnesses that spoke for the defendants were not to be believed. How many people of color was on the juries.
Chris Stone was beaten and left for dead a month earlier by Dale Depue and Shawn Aldridge over a drug deal. Beaten the dame way Hartman was beaten to death. They were out the night Hartman was murdered, looking to beat someone up to steal money to celebrate one of their birthdays.
They were convicted of the brutal murder of Maurice Smith a cabdriver who was murdered after the men were in jail. They confessed to the murder and still received lesser sentences than the Native men who still say they didn't commit murder.
Arlo Olson states he saw Marvin Roberts and the others beating up Franklin Dayton Jr. from a distance that the mens faces would have been smaller thatn a gnats head. On a dark October night after all day and night of hard liquor and pot. The description of the getaway car doesn't match Marvin Roberts but it matches Dale Depues car.
Racism is ugly. Especially when it's practiced by people with the power of freedom over the same people it's being used on.
Perpetuated by the racist and illiterate comments by small minded bigots such as the commentors on this post!

I'm sorry KYUGRL... did you tell him to just grow up and then insult him? I'm not sure that makes you look any better. Sorry.

It boggles me that so many people believe this child was "drunk" when he admitted guilt. He may have been under the influence when he was arrested, but HOURS later he's still as under the influence as when he began?!? I have a good feeling that the justice system doesn't offer alcoholic beverages.
If you read the interrogations it was 12:50p when he began to confess and then 7:00p when he continued to confess. Seems to me like, unless the jail was offering him alcoholic beverages while being interrogated, he had a reasonable amount of time to sober up. The "he was drunk" excuse becomes less and less dependable as the hours pass.

OMG, I am appalled reading some of these comments.
Sounds like there is a lot of growing up to do amongst some of you.
This crime that was committed was horrible.
If either one of the four men are innocence, then why don’t they
go through their legal counsel and tell the truth to clear their names.
This bashing of racism will not get an individual anywhere, it is just a mirror image of one’s self.

KYUGRL: You can get upset all you want. Start blaming everybody and everything all you want, but what this all really comes down to is: “Where are your family values?” Your cousin had everything on a golden platter for example: Monthly monetary stipend, a home to go to, free college education after completing high school at Howard Luke. For a lack of a better term, let’s just say not every one within the community gets these luxuries without have to work for them. AND Yet, He chose to roam around the streets drinking, selling drugs and living some wanabe gangster life. If you and/or your family were truly concerned, you could have prevented this young 17 year old from taking the path he currently is on. His issues did not just spring up out of nowhere so your well thought out quote of” WHAT GOES AROUND COMES AROUND” seems to hit home for you just a bit. I mean really, what do you expect, FREE DAYCARE too? Well since your family couldn’t do the right thing, we the state will take care of him in jail. Thanks for being in outstanding family member.

EUGENE VENT: You know what you did and you are being held accountable for your actions. I truly hope you will have learned from your poor choices. You had everything handed to you and now look at ya tough guy. Enough said.

They interrogated 17 year old vent for 10 hours while denying his requests for food or his mom. it's in the so called confessions. He was a kid being forced to say that he was in some sort of fight on 9th and barnette. The shoe prints never matched up and the getaway car never had a shred of dna or hair on it that matched the crime scene. This case needs to be reopened.

Well let’s see, from all of you posting currently, you have not discussed your point of view to educate all of “Idiots”. In reality, you’re hurting your cause and your name calling/finger pointing is just ignorant. Did your parents give you permission to be on the computer today or are you being neglected again. You’re not out following your cousins’ path are you?

KYUGRL: I never even mentioned the fact that Eugene is native but you did. So is it your view that since he is native, the rules and regulations of our state should not apply to him? I am reviewing the same public information as everyone else and the facts are he admitted to doing the horrible crime…..BUT, could you and/or your family have prevented the whole situation…..absolutely!
