Purse snatcher gets suspended sentence

FAIRBANKS — A man accused of stealing a woman’s purse pleaded guilty Thursday to that charge as well as two previous charges.

Vitaliy Gayvoronskiy, 31, appeared in Judge Michael A. MacDonald’s courtroom to plead guilty to one count of theft in the second degree, one count of driving with a suspended license and one count of fleeing the scene of a car accident.

Court records stated that on June 22 about 4:40 a.m., Gayvoronskiy rode a bicycle up to a woman walking in the downtown area, threatened her and grabbed her purse.

The purse was never recovered, but a bottle of pills with the victim’s name and Hawaiian pharmacy on the label was found on Gayvoronskiy. The purse contained the woman’s ID cards, including her Medicare card and her birth certificate.

Gayvoronskiy received a sentence of 12 months in prison for the theft, with all 12 months suspended. He also received a sentence of 12 months of probation, meaning Gayvoronskiy will serve no jail time for the theft unless he violates the terms of his probation.

He was ordered to pay restitution for the stolen purse, with the value of the purse and its contents to be determined at a later hearing. Gayvoronskiy was also ordered to submit to a search of his property and financial assets for any stolen property.

Judge MacDonald lowered the public defender’s attorneys fees from $850 to $250, in part because Gayvoronskiy was primarily represented by an intern from the Office of Public Advocacy.

“That is a bargain,” MacDonald said, in response to the defense counsel’s request that the fees be waived entirely.

For the charge of fleeing the scene of a motor vehicle accident, Gayvoronskiy received 20 days of jail time with 10 suspended. For driving with a suspended license, he received 30 days of jail time with 20 suspended. Gayvoronskiy was ordered to serve 10 days in jail, which he has already served at Fairbanks Correctional Center since being arrested for the theft.

He also must perform 10 days of community service.

Does anyone remember the guy last year that got a deal at the Regal Cinema, 21 thefts including stealing a diaper bag from an 8 year old. Got sentenced for 21 'concurrent' sentences, or was it 20 suspended and 1 served. (Does it really matter!?)

This is ridiculous. I don't want to fill up the jails with petty larceny but 30 days for petty 10X restitution, legal fees, and 30 days of community service. Increase that more for grand theft and repeat offenders. Make it hurt.

So crimes towards another person there's no penalty, but someone grows some weed at home and they get the book thrown at them. What is wrong with our judicial system? Does anyone actually get punished anymore?

This is absolutely shameful. The criminals here get off with light or no sentences, others who have done nothing are treated as criminals by the courts. Something is wrong in this system.

Let that be a lesson to you crimes against a person mean nothing, but Do Not violate the State's licensing laws.

Pardon me, but isn't that exactly the wrong reasoning Judge Mcdonald? After all, there was no loss to the State, but there was an actual loss to the victim. Shouldn't the victims loss have outweighed the State's concerns?

You were right of course, that was a bargain.

what a travisity of justice we have a eldery woman gets robbed and the judge should be tarred and feathered and ran out of town on a rail. but he is just following in the footsteps of the crooks who started fairbanks. i hope more people start to carry downtown and take care of justice instead of depending on the crooked judical system.

What we don't owe him some money?? How could we turn him loose with out paying him for his inconvenance....

Ol' Macdonald needs to be retired to the farm...or dressed up like a clown & made to stand on the corner near the box stores with a sign that says " Get out of jail free for a happy meal" Sorry a$$ judges in this town.....

Judge Michael A. MacDonald had to have been on a heavy dose of medication that day. I'm not so sure I'd do better but at least a year of community service if he had to forego for some reason jail time. Imagine that?! In FAIRBANKS! An older woman gets robbed and basically nothing happens to her assailant. Something bad has happened to the Golden Heart of Alaska. Something very sad. X(

So he learned that there is no real penalty for robbing individual people, but don't violate traffic laws.

I don't know the details of this decision but it doesn't seem right that he serves no time for the robbery.

ALL WE CAN HOPE FOR IS THAT THE NEXT TIME HE ROBS THE JUDGE. I ALSO WONDER WHERE HE WILL STEAL THE MONEY TO PAY THE RESTITUTION, HOPE IT IS FROM THE DEFENSE COUNSEL OR THE JUDGE.

WHEN DID IT HAPPEN THAT YOU NEED A DRIVERS LICENSE TO RIDE A BICYCLE??

This is rediculous. The guy who fired a machine gun but didn't hurt anyone got 2 years in jail. This guy gets nothing.

If his unsuspended time is 20 days, how come he is only serving 10 days? Did anyone think to ask him what he did with the purse? (He probably threw it in the river.)
