Vitaliy Gayvoronskiy, 31, appeared in Judge Michael A. MacDonald’s courtroom to plead guilty to one count of theft in the second degree, one count of driving with a suspended license and one count of fleeing the scene of a car accident.
Court records stated that on June 22 about 4:40 a.m., Gayvoronskiy rode a bicycle up to a woman walking in the downtown area, threatened her and grabbed her purse.
The purse was never recovered, but a bottle of pills with the victim’s name and Hawaiian pharmacy on the label was found on Gayvoronskiy. The purse contained the woman’s ID cards, including her Medicare card and her birth certificate.
Gayvoronskiy received a sentence of 12 months in prison for the theft, with all 12 months suspended. He also received a sentence of 12 months of probation, meaning Gayvoronskiy will serve no jail time for the theft unless he violates the terms of his probation.
He was ordered to pay restitution for the stolen purse, with the value of the purse and its contents to be determined at a later hearing. Gayvoronskiy was also ordered to submit to a search of his property and financial assets for any stolen property.
Judge MacDonald lowered the public defender’s attorneys fees from $850 to $250, in part because Gayvoronskiy was primarily represented by an intern from the Office of Public Advocacy.
“That is a bargain,” MacDonald said, in response to the defense counsel’s request that the fees be waived entirely.
For the charge of fleeing the scene of a motor vehicle accident, Gayvoronskiy received 20 days of jail time with 10 suspended. For driving with a suspended license, he received 30 days of jail time with 20 suspended. Gayvoronskiy was ordered to serve 10 days in jail, which he has already served at Fairbanks Correctional Center since being arrested for the theft.
He also must perform 10 days of community service.


This is ridiculous. I don't want to fill up the jails with petty larceny but 30 days for petty 10X restitution, legal fees, and 30 days of community service. Increase that more for grand theft and repeat offenders. Make it hurt.
Pardon me, but isn't that exactly the wrong reasoning Judge Mcdonald? After all, there was no loss to the State, but there was an actual loss to the victim. Shouldn't the victims loss have outweighed the State's concerns?

I don't know the details of this decision but it doesn't seem right that he serves no time for the robbery.
